Sustainable Energy Law Notebook

After last year success, the Florence School of Regulation (FSR) of the European University Institute  is organising again this year its Summer School on Energy Policy & EU Law from 18 to 22 June 2012 . The Summer School will cover the most central topics in EU energy policy , including: competition in energy markets; security of energy supply; new regulatory developments (REMIT, infrastructure, ACER, etc.); and sustainable energy. Thanks to FSR renewed confidence, I will be teaching on "the promotion of renewable energy sources and free movement of goods" . Norges vassdrags- og energidirektorat (NVE ) publiserte i dag en kort nyhetssak   for å opplyse at godkjenning av anleggene under elsertifikatordningen blir ikke automatisk og at direktoratet skal sørge for at godkjenningskriterier skal oppfylles fullt ut. De er særlig opptatt av at anlegget skal være " bygget i samsvar med gitt konsesjon, konsesjonsvilkår eller forutsetninger for fritak for konsesjonsplikt ". NVE har oppdaget flere avvik mellom bygget kraftverk og det NVE har gitt tillatelse til . Det betyr at behandling av søknader kan ta ekstra tid . Hvor mye dette skal påvirke elsertifikatmarkedet er ikke opplyst. For å være godkjent anlegg under elsertifikatordningen og være " elsertifikatberettiget " må innehaveren av et produksjonsanlegg oppfylle vikårene i Elsertifikatloven kap.2 og Forskrift om elsertifikater, kap. 2. I følge §9, 2. ledd i Forskriften må produksjonsalegget, bl.a., være bygd i samsvar med konsesjon, konsesjonsvilkår eller forutsetninge...

Norges vassdrags- og energudirektorat (NVE) publiserte i dag Produksjonsstatistikk for Vindkraft i 2011 . NVE rapporterer at produksjon av vindkraft i 2011 tilsvarte : Samlet installert ytelse [MW] 511,5 Produksjon [GWh] 1 308 (brutto produksjon) Antall registrerte vindkraftverk 18 Antall installerte turbiner 239 Gjennomsnittlig turbinstørrelse [MW] 2,2 Brukstid (kun kraftverk i normal drift) 2737 Kapasitetsfaktor [%] 31,3 Vindindeks [%] 113,1 Tilgjengelighet [%] 94,7 Vindkraft bidrar nå til 1,0 % av landets samlede kraftproduksjon . Fremtidig bildet av vindkraftbransjen i Norge må likevel avklares konstant , særlig når Marit L. Fossdal, avdelingsdirektør i NVE, kommenterer at " De gunstige vindforholdene er den viktigste grunnen til at vindkraftverkene produserte mer enn normalt i fjor ."  Det ser fremdeles ut som at Norge må gjennomføre sin stor transisjon og sette seg inn i et industrielt ...

The European Commission and the EFTA Surveillance Authority performed yesterday, 7 February 2012, a series of unannounced inspections in the electricity sector in several European countries (at least in Norway, France, Sweden and Finland). They targeted particularly power exchanges , as they suspect that some of them may have infringed EU antitrust rules on cartels and restrictive business behaviours . Such practices are prohibited by Articles 101 TFEU and Article 53 EEA Agreement .  As regards Norway and France, it seems like the inspection focused on coordination of behaviours by sharing the market between themselves. The announcement of a Joint Venture in September 2011 between Nord Pool Spot and EPEX Spot with the intention of establishing a joint IT system platform was also at the center of the European authorities inspections (see press release by EPEX Spot, 28.09.2011). The Norwegian government is in favour of the so-called electrification of the shelf ( elektrifisering av sokkelen ), which means the  electrification of the oil and gas platform . I will comment this new focus on a relatively old topic on the Norwegian Continental Shelf more in detail rapidly. But, after today's seminar organised by ZERO in Oslo, a policy question remains . Does the government has a consistent strategy for electrifying the platforms , or, as put forward by the representative of the Ministry for Petroleum and Energy, it will be evaluated on a case-by-case basis . Time has come to define a clear strategy for electrification of the shelf, as part of the general energy and climate national policy.
